Who Will Actually Insure a Bar or Nightclub?

You searched "bar insurance" or "nightclub insurance" and clicked the biggest name on the page. Then you found out they will not write you.

I get it. It is frustrating, and it makes you feel like your business is uninsurable. It is not. You were just knocking on the wrong door.

We have been in hospitality insurance for over 30 years. Here is how the market for bars and nightclubs really works, who writes this business, and what to do if you just got a non-renewal.

Many of the Big Insurance Brands Do Not Write Bars

The companies with the biggest ad budgets are built for easy accounts: coffee shops, quick service restaurants, offices. A bar or nightclub is a different animal.

Look at what they say on their own pages:

  • The Hartford's bar insurance page says "The Hartford doesn't offer bar insurance online" and sends visitors to a third-party lead site for a quote.

  • ERGO NEXT's liquor liability page says "ERGO NEXT does not offer bar insurance or liquor liability insurance for bars." It offers liquor liability only as an add-on for restaurants, caterers and similar businesses.

Neither company is hiding anything. They are just not built for your risk. The problem is that their pages show up first, and a lot of owners never get past them.

Where Bar and Nightclub Insurance Actually Comes From: The Surplus Lines Market

Most bars and nightclubs end up in what the industry calls the surplus lines market, also called excess and surplus, or E&S.

Here is the difference in plain terms.

  • Admitted carriers are licensed in your state and file their rates and policy forms with the state.

  • Surplus lines carriers write the risks admitted carriers will not. They have more freedom on price and policy wording, which is why they can say yes to a nightclub.

Standard carriers often stop writing liquor liability once alcohol reaches 25% to 30% of total sales, Insurance Business reported in January. Insurance Journal reported in March that the market is still hard for venues with more than 40% of sales from alcohol. Most bars and every nightclub I know are over that line.

What surplus lines means for you

Surplus lines is not bad insurance. For a nightclub it is usually the only insurance. But you need to know three things.

  1. It has to go through a licensed surplus lines broker. You cannot buy it directly from the carrier, according to the National Association of Insurance Commissioners.

  2. There is no state guaranty fund behind it. If an admitted carrier goes broke, a state fund steps in to pay claims. The NAIC says that protection is not available for surplus lines. That makes the carrier's financial strength rating matter more.

  3. The policy wording varies a lot. Two quotes that look the same can have very different exclusions. Assault and battery, firearms and outside security are the big ones. I broke those down in Does Bar Insurance Cover a Fight or a Shooting?

What Makes a Carrier Say No to a Bar or Nightclub

Every underwriter is trying to answer one question: how likely is a big claim at this venue? These are the things that move the answer.

  • Alcohol share of sales. The higher the percentage, the fewer carriers will look at it.

  • Late hours. Being open until 2 a.m. or later narrows the market fast.

  • A dance floor, DJs and promoters. Entertainment has to be disclosed. Insurance Journal reports the restricted market may exclude it.

  • Claims history. Insurance Journal reports that three years in business with no assault and battery or overserving claims opens up the market.

  • New venture. No track record means fewer carriers and higher prices.

  • Your state. Some states are much harder than others because of their dram shop laws. Independent Agent magazine reported in August that premiums in some states have jumped 300% to 600%.

What It Costs When a Carrier Says Yes

Now look, I am not going to lie to you. This is where owners get sticker shock, because the prices online are for small, low-alcohol accounts.

For a nightclub, most minimum premiums I see run $25,000 to $35,000 for the package, meaning general liability and liquor liability together. That is before your size, hours, claims and state come into it. Insurance Journal described a business with about $1.6 million in sales and significant alcohol revenue that was charged almost $90,000.

If someone quotes you a few thousand dollars a year for a nightclub, read the policy very carefully. Something is probably excluded.

Got a Non-Renewal? What to Do Next

A non-renewal feels like the end of the world. It usually is not. Here is what I tell owners.

  1. Do not wait. Start at least 90 days before your policy ends. Good placements take time.

  2. Pull five years of loss runs. These are the claim reports from every carrier you have had. You can request them from each one.

  3. Get the reason in writing. A carrier leaving your state is a very different story from a claim problem.

  4. Pick one agent to shop it. In the wholesale market, the first agent to submit your account to a carrier usually holds that spot. If three agents shop you at once, carriers can see conflicting submissions, and some may not quote you at all.

  5. Tell the truth on the application. Hours, entertainment, security, alcohol percentage. A claim denied for a misstatement is much worse than a higher premium.

How to Check Who Insures Your Bar Right Now

Pull out your declarations page, the first page of your policy, and look for three things.

  • The carrier's name. Not your agent's name and not the program name. The actual insurance company.

  • A surplus lines notice. Surplus lines policies carry a stamp or disclosure saying the carrier is not licensed by your state.

  • The carrier's rating. Look it up on AM Best. A financially strong carrier matters even more when there is no guaranty fund behind it.

Why the Agency You Use Matters

Here is something most owners do not know. Underwriters in this market do not just judge your bar. They judge the agency sending it.

Hospitality has been our focus for over 30 years. We are careful about which owners we bring to a carrier, and that keeps our loss ratio low. When an underwriter sees a submission from an agency whose accounts perform, the conversation starts in a better place. That does not guarantee any single quote. It does mean your application gets read by someone who already trusts where it came from.

The Bottom Line on Who Insures Bars and Nightclubs

The biggest names in insurance often do not write bars. Most bars and nightclubs are insured in the surplus lines market, through brokers who know it. The coverage is real, but the price is higher and the policy wording deserves a careful read.
